Understanding Federal and State Cannabis Tax Compliance is no longer optional for professionals working in or with the cannabis industry—it’s essential. As cannabis legalization evolves at the state level while remaining federally illegal, operators and their advisors are forced to navigate one of the most complex regulatory and tax environments in the business world. But there’s a workaround: certain costs of goods sold (COGS) can still be deducted. This is where skilled cannabis accountants add significant value by properly allocating expenses within the legal limits of 280E.
State-level taxes add another layer of complexity. Depending on where your clients operate, they could be dealing with cannabis excise taxes, local gross receipts taxes, sales taxes, and business and occupation (B&O) taxes. For example, California requires a Cannabis Excise Tax return, while states like Oregon impose distinct rules on inventory tracking and transfer pricing between vertically integrated entities. Understanding these nuances is critical to ensuring compliance while maximizing after-tax income.
